19. Dispute Resolution:

a) Informal Negotiations:

To expedite dispute resolution and manage costs related to disputes concerning these Legal Terms (each a ‘Dispute’ and collectively, the ‘Disputes’) initiated by either party (individually, a ‘Party’ and collectively, the ‘Parties’), both Parties agree to initially attempt to resolve any Dispute informally for at least thirty (30) days, beginning upon written notice from one Party to the other.

b) Binding Arbitration:

Any Dispute arising from these Legal Terms, including questions regarding its validity, existence, or termination, shall be referred to and conclusively resolved by arbitration in accordance with Indian law. The arbitration panel shall consist of two (2) arbitrators. The legal seat of arbitration shall be Durg, Chhattisgarh, India, and the proceedings shall be conducted in English. Indian substantive law shall govern these Legal Terms.

c) Restrictions:

The Parties agree that any arbitration shall exclusively address Disputes between the Parties individually. To the fullest extent permissible under law: (a) no arbitration shall consolidate with any other proceedings; (b) Disputes shall not be arbitrated on a class-action basis or use class action procedures; and (c) Disputes shall not be arbitrated in a representative capacity on behalf of the general public or other persons.

d) Exceptions to Informal Negotiations and Arbitration:

The Parties agree that the following Disputes are not subject to the above provisions regarding informal negotiations and binding arbitration: (a) Disputes involving enforcement, validity, or protection of any Party’s intellectual property rights; (b) Disputes arising from allegations of theft, piracy, privacy invasion, or unauthorized usage; and (c) Claims for injunctive relief. Should this provision be found illegal or unenforceable, neither Party shall elect to arbitrate any Dispute encompassed by such a portion, and the Dispute shall be adjudicated in a court of competent jurisdiction within the courts listed for jurisdiction above, with both Parties consenting to the personal jurisdiction of that court.

The Services may contain information with typographical errors, inaccuracies, or omissions, including descriptions, pricing, and availability. We reserve the right to correct errors, inaccuracies, or omissions and to update information on our Services at any time, without prior notification.
